Terms for posters
Last updated
These terms apply when you publish a listing on Berlin Sublets, run by [NAME] (see the Impressum). You accept them when you publish. Browsing and contacting posters need no account and no agreement.
Who may post
List only a place you may sublet: your own room or flat, or one whose tenant or owner asked you to list it. One listing per place.
Keep it accurate
Price, dates, location and photos must match the real place. Photos must show that place. Mark the listing as taken or remove it as soon as it is no longer available.
Your sublet must be legal
You are responsible for your sublet complying with the law. In Germany, subletting usually needs the landlord's permission (Untervermietungserlaubnis). Getting it is up to you; we do not check it.
Listings must not discriminate against anyone, must not be misleading or fraudulent, and must not contain personal data of other people without their permission.
Your text and photos
You confirm you have the rights to the text and photos you upload. You allow us to show them on the site, in search alerts and in shared links to your listing for as long as it is published. They stay yours.
Contact happens off the site
Renters contact you directly through the channels you entered (Telegram, WhatsApp, SMS, email or Instagram). There is no messaging on the site. Viewings, contracts and payments are between you and the renter; we are not a party to them.
Free to use
Listing and contacting are free. If paid options are added later, such as promoting a listing, they will be optional and clearly marked, and nothing will cost money without you choosing it.
Availability checks
To keep the map current, we ask you by email or Telegram whether your sublet is still available, 10 days after publishing and every 10 days after each "yes". One tap answers. Without an answer within 4 days, the listing is hidden. It is also hidden 3 days after the move-in date has passed. You can bring it back from My sublets at any time.
If you switch availability checks off under Notifications, we do not ask and do not hide your listing for lack of an answer.
Listings from public posts and claiming
Some listings summarize public posts found elsewhere and link to the original. If one is yours, sign in with the Telegram account that posted it to claim it: it becomes your listing under these terms, with your Telegram handle as contact.
If you would rather not have it here, use "Request removal" on the listing or write to [EMAIL]. We handle the request by hand, remove the listing within 24 hours and do not import posts from that handle again.
Hiding and removing listings
We may hide or remove listings that break these terms or the law, that reports show to be wrong, or that look like fraud. When we do, we tell you why through your notification channel, and you can object by writing to [EMAIL].
Ending
You can remove your listings or delete your account at any time in My sublets. We may close the site or change these terms; we tell you about important changes in advance, and they apply only from then on.
Liability
We try to keep the site available and listings accurate, but cannot guarantee either. We are not responsible for listings from public posts, for what renters and posters agree, or for how they behave.
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and where the law mandates it, such as under the Product Liability Act. For slight negligence we are liable only for breach of an essential obligation, limited to the typical, foreseeable damage.
Applicable law
German law applies. If you are a consumer living in another EU country, the mandatory consumer protection rules of that country still protect you.
